Agreement to Terms

By accessing or using Pensteady ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

Pensteady is an AI-powered SEO content generation platform that creates, optimizes, and publishes articles to your connected content management systems (WordPress, Webflow, Ghost, etc.).

We provide both subscription-based and pay-per-article services for automated content creation and publication.

Account Registration

To use certain features of the Service, you must register for an account. You agree to:

Provide accurate, current, and complete information
Maintain the security of your password
Notify us immediately of any unauthorized use
Be responsible for all activities under your account
Not share your account credentials with others

Subscription and Payment

Subscription Plans

We offer various subscription tiers (Starter, Growth, Pro, Business, Enterprise) with different article volumes and features. Subscription fees are billed in advance on a monthly or annual basis.

Pay-Per-Article

For users who prefer not to subscribe, we offer a pay-per-article option. Payment is due before article generation begins.

Billing

All fees are non-refundable except as required by law
You authorize us to charge your payment method on a recurring basis
We reserve the right to change our pricing with 30 days notice
Failure to pay may result in service suspension or termination

Cancellation and Refunds

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period.

We do not provide refunds for partial months or unused articles, except in cases of service failure or as required by law.

Annual subscriptions may be eligible for pro-rated refunds within the first 30 days, at our discretion.

Content Ownership and License

Your Content

You retain all rights to content generated through our Service. Once an article is delivered and paid for, you own the content and may use it however you wish.

License to Us

You grant Pensteady a limited license to use your brand information, keywords, and other input data solely for the purpose of generating content for you.

Content Quality

While we strive to create high-quality, accurate content, all content is AI-generated and should be reviewed before publication. You are responsible for ensuring content accuracy and compliance with your industry regulations.

Acceptable Use Policy

You agree not to use the Service to:

Generate content that violates any law or regulation
Create spam, malware, or phishing content
Infringe on intellectual property rights
Generate hateful, discriminatory, or harmful content
Attempt to reverse-engineer or copy our technology
Resell or redistribute our services without authorization
Use the service for illegal or unethical purposes

API Access

API access is provided to certain subscription tiers and pay-per-use customers. API usage is subject to rate limits and fair use policies.

You must keep your API keys secure and confidential
Excessive API usage may result in throttling or additional charges
We reserve the right to revoke API access for abuse

Revisions and Support

Revision limits vary by plan:

Starter: 1 revision per article
Growth: 2 revisions per article
Pro and Business: Unlimited revisions
Pay-per-article: 1 revision included

Revision requests must be submitted within 14 days of article delivery.

Third-Party Integrations

Our Service integrates with third-party platforms (WordPress, Webflow, Ghost, etc.). We are not responsible for:

The availability or functionality of third-party services
Data loss or corruption on third-party platforms
Changes to third-party APIs or authentication methods

You are responsible for maintaining valid credentials and access to your connected platforms.

Service Availability

We strive to provide 99.9% uptime but do not guarantee uninterrupted service. We reserve the right to:

Perform scheduled maintenance with advance notice
Temporarily suspend service for security or technical reasons
Modify or discontinue features with reasonable notice

Limitation of Liability

To the maximum extent permitted by law, Pensteady shall not be liable for:

Indirect, incidental, or consequential damages
Loss of profits, revenue, or business opportunities
Data loss or corruption
Errors or inaccuracies in generated content

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Indemnification

You agree to indemnify and hold harmless Pensteady from any claims, damages, or expenses arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Content you publish using our Service

Termination

We reserve the right to suspend or terminate your account at any time for:

Violation of these Terms
Fraudulent or illegal activity
Non-payment of fees
Abusive behavior toward our team or other users

Upon termination, your right to use the Service ceases immediately. We may delete your data after 30 days.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.
